Text Messaging Programs: Terms & Conditions

Effective Date: 6/1/2026

Spectrum Resorts LLC (“Spectrum Resorts,” “Spectrum,” “we,” “us,” or “our”) offers text messaging programs to provide customer care, service notifications, operational updates, reservation-related communications, property updates, and other service-related communications to guests, owners, residents, customers, employees, and other individuals who choose to communicate with us by text message or otherwise provide consent to receive text messages.

These Text Messaging Terms & Conditions govern Spectrum Resorts text messaging programs.

Program Description

Spectrum Resorts may send SMS or MMS text messages for customer care, service, transactional, operational, and notification purposes. Depending on your relationship or interaction with Spectrum Resorts, messages may include:

  • Responses to customer service or guest service inquiries
  • Reservation, arrival, departure, or stay-related updates
  • Property, resort, or operational notifications
  • Maintenance, service request, or work order updates
  • Owner, resident, guest, or customer communications
  • Appointment, request, or follow-up messages
  • Employee or internal communication messages, where applicable
  • Help, confirmation, and opt-out messages related to the text messaging program

Spectrum Resorts text messaging programs are intended for communications related to your interaction with Spectrum Resorts. These programs are not used for third-party marketing, lead generation, affiliate marketing, or unrelated promotional messaging.

Spectrum Resorts Team Shout-Out Line

Spectrum Resorts may provide an internal SMS shout-out line that allows team members to voluntarily submit coworker recognition messages to Human Resources for review. Team members may text the shout-out line to recognize coworkers for great service, teamwork, guest support, positive workplace contributions, or other internal recognition.

By texting the shout-out line, you agree to receive SMS replies related to your submission, including confirmation, HELP, and STOP messages. Message frequency varies based on your interaction with the line. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help.

Shout-out submissions may be reviewed by Spectrum Resorts Human Resources before any internal sharing or recognition. This SMS program is not used for marketing, sales promotions, guest communications, third-party advertising, lead generation, or affiliate marketing.

Opt-In and Consent

You may opt in to receive text messages from Spectrum Resorts in several ways, including but not limited to:

  • Providing your mobile number through a Spectrum Resorts website form
  • Providing your mobile number during a reservation, guest service, owner service, resident service, employee, or customer service interaction
  • Submitting a request that includes your mobile number
  • Texting a published Spectrum Resorts phone number or notification line
  • Replying to a Spectrum Resorts text message
  • Providing other express consent to receive text messages from Spectrum Resorts

By providing your mobile number, texting Spectrum Resorts, or otherwise opting in, you agree that Spectrum Resorts may send you SMS or MMS text messages related to your request, reservation, stay, property, account, employment-related communication, service interaction, or other relationship with Spectrum Resorts.

You may be asked to confirm your consent, such as by replying YES or Y to an initial text message.

Consent to receive text messages is not required as a condition of purchasing goods or services from Spectrum Resorts.

Message Frequency

Message frequency varies based on your interaction with Spectrum Resorts and the type of communication program. Some text messaging programs may involve one-time or limited-duration messages, while others may involve recurring service or notification messages.

Spectrum Resorts reserves the right to change message frequency at any time. If we make a material change to the frequency of a recurring text messaging program, we may notify active participants by text message and provide an opportunity to opt out.

Message and Data Rates

Message and data rates may apply. Charges are billed by and payable to your mobile service provider. Spectrum Resorts is not responsible for any messaging or data charges that may apply.

Message delivery is subject to your mobile carrier and network availability. Not all mobile devices, carriers, or plans may support every text messaging service. Prepaid users may not be able to participate in certain programs. Please contact your mobile service provider with questions about your text messaging plan.

Opt-Out Instructions

You may opt out of Spectrum Resorts text messages at any time by replying STOP to any Spectrum Resorts text message.

After you reply STOP, you may receive one final confirmation message stating that you have been unsubscribed. After that, you will no longer receive text messages from that specific text messaging program unless you opt in again.

If you are enrolled in more than one Spectrum Resorts text messaging program, opting out of one program may not opt you out of all programs. You may need to reply STOP to each applicable messaging program or contact us for assistance.

Help Instructions

For help, reply HELP to any Spectrum Resorts text message.

Spectrum Resorts and mobile carriers are not liable for delayed, undelivered, or misdirected messages.

Changes to These Terms

Spectrum Resorts may update or modify these Text Messaging Terms & Conditions at any time. Any changes will be effective when posted to this page unless otherwise stated.

If we make material changes to these terms, we may notify active participants by text message or through another reasonable method.

Your continued participation in a Spectrum Resorts text messaging program after changes are posted constitutes your acceptance of the updated terms.

Disclaimer of Warranties; Limitation of Liability

Spectrum Resorts text messaging programs and related materials are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Spectrum Resorts makes no warranties, express or implied, regarding the availability, accuracy, completeness, reliability, or timeliness of text messaging services.

To the fullest extent permitted by applicable law, Spectrum Resorts, its parents, subsidiaries, affiliates, divisions, joint ventures, service providers, employees, officers, directors, members, managers, agents, and representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation in Spectrum Resorts text messaging programs.

This limitation applies to damages resulting from any failure of performance, error, omission, interruption, deletion, defect, delay, transmission issue, network failure, unauthorized access, or other event beyond our reasonable control.

Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Spectrum Resorts and its parents, subsidiaries, affiliates, divisions, joint ventures, service providers, employees, officers, directors, members, managers, agents, and representatives from and against any claims, demands, losses, liabilities, damages, judgments, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising from or related to your use of Spectrum Resorts text messaging programs or your violation of these terms.

Arbitration Notice

Except for certain types of disputes described in the Arbitration/Class-Action Waiver/Dispute Resolution section below, you and Spectrum Resorts agree that disputes between you and Spectrum Resorts will be resolved by binding, individual arbitration. That means an arbitrator, not a judge or jury, will decide any dispute. You also waive your right to bring or participate in a class, consolidated, representative, collective, or private attorney-general action or arbitration.

Arbitration/Class-Action Waiver/Dispute Resolution

Please read this section carefully. It affects your rights.

All matters arising out of or relating to these Text Messaging Terms & Conditions, your participation in any Spectrum Resorts text messaging program, or any related dispute, controversy, or claim shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to any conflict of law principles that would require the application of the laws of another jurisdiction.

Before commencing arbitration, you agree to first attempt in good faith to resolve any dispute by negotiation and consultation with Spectrum Resorts by sending written notice describing the nature of the dispute to:

Spectrum Resorts LLC
925 Beach Club Trail
Gulf Shores, AL 36542
Email: info@spectrumresorts.com

Upon receipt of your notice, Spectrum Resorts will attempt to address and resolve the dispute. If the dispute is not resolved informally within thirty (30) business days after delivery of the notice, either party may commence binding arbitration.

Any dispute shall be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its applicable rules then in effect. The arbitration shall be conducted by a single neutral arbitrator unless otherwise required by applicable law or agreed by the parties.

The arbitration shall take place in Baldwin County, Alabama, unless the parties agree to another location or the arbitrator determines that a remote or alternative format is appropriate.

The arbitrator shall have authority to award any relief that would be available in court, subject to the limitations in these terms. Judgment on the arbitration award may be entered in any court having jurisdiction.

The parties agree to arbitrate solely on an individual basis. These terms do not permit class arbitration or any claims brought as a plaintiff or class member in any class, collective, representative, consolidated, or private attorney-general proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of representative or class proceeding.

If any portion of this arbitration agreement is found invalid or unenforceable, the remaining portions shall remain in effect to the fullest extent permitted by law.

Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction where necessary to protect rights or prevent irreparable harm.

Severability

If any provision of these terms is found to be invalid, unlawful, or unenforceable, that provision shall be modified or removed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
